Qualoo’s Terms and Conditions of Use

1. Introduction

Welcome to Qualoo (the “App”). By downloading or using Qualoo, you agree to these Terms & Conditions (“Terms”). If you do not accept these Terms, you must immediately uninstall and discontinue use of the App.

1.1 Who we are

Qualoo provides tools to help you measure, map, and analyze internet connectivity from your device. We also offer an in-app crypto wallet, enabling you to store digital assets. Certain data we collect (like network performance metrics) may be written to a blockchain for transparency and verification.

2. Eligibility & Account

Personal Account: You’re welcome to set up a personal account in Qualoo. We only request the minimum details needed—like an email address—to manage your account. If you prefer, you can also verify your account with an existing crypto wallet instead of providing an email. Other information, such as the country in which you’re using the app, can help us improve your experience but is entirely optional.
Device Permissions: Qualoo needs specific permissions—like location access, sending notification if you so wish, and the OS permission labeled “Make and manage phone calls” (for network operator details). We do not actually make or manage phone calls, but your device’s OS joins these permissions together, hence forcing us to need that permission enabled.

3. What Qualoo Does

Network Tests: The App runs tests (ping, DNS lookups, traceroutes, speed tests, etc.) on your internet connection to gather performance data.
Background Mode: These tests may run while the App is in the background, but only if enabled in the app.
Rewards: By using the App and allowing it to run various tests, you may earn points or other incentives. These rewards generally aren’t legal tender and can only be redeemed in the specific ways we designate—such as discounts, premium features, or vouchers for partner offerings (e.g., SIM cards, eSIMs, mobile data packages, device discounts, as well as deals with food and drink companies, hotels, travel services, and more). There may also be a future option to convert your points into tokens.
Crypto Wallet: We include a digital wallet that allows you to store cryptocurrencies or tokens. You bear sole responsibility for any private keys, seed phrases, or passcodes.

4. User Responsibilities

Data Costs: You are responsible for any data usage fees from your mobile or internet provider.
Accuracy: Do not falsify test results or otherwise interfere with how Qualoo collects data.
Crypto Wallet Security: Keep your wallet credentials (private keys, seed phrases) secure. If someone accesses your wallet, we are not liable for any loss of digital assets.
Compliance: You agree to use Qualoo in accordance with all applicable laws and regulations in your jurisdiction.

5. Intellectual Property & Licenses

Qualoo Materials: All trademarks, logos, text, images, and software in the App are owned by or licensed to Qualoo. You may not copy, distribute, or create derivative works without explicit permission.
User Content: If you provide feedback or suggestions, you grant Qualoo a non-exclusive, worldwide, royalty-free license to use it to improve our services.

6. Blockchain Disclaimer

Immutable Records: We will use blockchain technologies as audit trails, so certain performance metrics or timestamps will be recorded securely for verification. Once the relevant hash is on-chain, it cannot be deleted or altered.
Public Access: Blockchain data may be visible to third parties who explore, query, or analyze the relevant ledger.

7. Termination

Qualoo may suspend or terminate your access to the App (in whole or in part) at any time, for any reason, with or without notice. Upon termination, you must cease all use of the App and remove it from your device.

8. Disclaimer of Warranties

The App (including network tests, crypto wallet, and blockchain features) is provided “as is” and “as available”. To the maximum extent permitted by law, Qualoo disclaims all warranties—express, implied, or statutory—relating to the App, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

Under no circumstances will Qualoo be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or related to your use of or inability to use the App. This includes loss of data, loss of digital assets (cryptocurrency), or damage to your device. Your exclusive remedy is to stop using the App.

10. Indemnification

You agree to indemnify and hold Qualoo, its affiliates, employees, and agents harmless from any claims, losses, damages, or expenses (including legal fees) arising from your breach of these Terms or misuse of the App.

We may modify these Terms at any time. Any changes will be posted within the App and/or on our website. By continuing to use Qualoo after changes become effective, you agree to the revised Terms.
